This Privacy Policy explains how collony.ai (“we,” “our,” “us”), operated by Collony LLC, collects, uses, and protects your personal data when you use our services. We are committed to complying with the General Data Protection Regulation (GDPR) and ensuring transparency about how your data is handled.

1. Data We Collect

When you use collony.ai on platforms such as Telegram or Discord, we may process the following data:

- Message content: community chat messages in groups where collony.ai is active, including those flagged for moderation or answered by the bot.
- Metadata: usernames, user IDs, timestamps, and group/channel details.
- Logs:  moderation decisions, rule violation records, and bot responses (for observability and troubleshooting).
- Payment data: handled by Stripe if you purchase our services (we do not store payment details ourselves).

We do not intentionally collect sensitive categories of data (e.g., health, political, or religious beliefs).

2. Purpose and Legal Basis for Processing

We process your data only as permitted by law:

- Service delivery: to provide moderation, support, and community management features. (Contract, Art. 6(1)(b) GDPR)
- Improvement & security: to monitor performance, prevent abuse, and improve the service. (Legitimate interests, Art. 6(1)(f) GDPR)
- Compliance: to meet legal obligations (e.g., accounting). (Legal obligation, Art. 6(1)(c) GDPR)

We do not use your data for profiling or advertising.

- OpenAI: Some chat data is securely transmitted to OpenAI (ChatGPT) for processing. OpenAI acts as a data processor on our behalf.
- Payment provider: Payment data is processed by Stripe.
- Legal obligations: We may disclose data if required by law or to protect rights, safety, or property.

We do not sell or share your data with third parties for marketing.

We only keep data as long as needed:

- Moderation & observability logs: typically up to 90 days, unless longer retention is required for security or compliance.
- User messages: not stored permanently; only retained within the log period.
- Payment records: retained as required by tax/accounting laws.

After these periods, data is deleted or anonymized.

Some processing (e.g., via OpenAI or Stripe) may involve transfers of your data outside the European Economic Area (EEA), including to the United States.

We ensure appropriate safeguards, such as Standard Contractual Clauses (SCCs) approved by the European Commission.

We apply technical and organizational measures to protect your data, including:

- Encryption in transit and at rest
- Access controls
- Monitoring and auditing

No system is entirely risk-free, but we work to minimize risks.

As an EU data subject, you have the right to:

- Access your personal data
- Correct inaccuracies
- Request deletion (“right to be forgotten”)
- Restrict or object to processing
- Request data portability
- Lodge a complaint with your local data protection authority

collony.ai is not directed to children under 13. We do not knowingly collect data from children.

We may update this Privacy Policy periodically. Material changes will be announced via our website, service notifications, or email, with reasonable notice before they take effect.
